The main objective of the Subscriber Identity Module (SIM) Card Registration Act is to help law enforcement agencies like the Philippine National Police conduct investigations and track down lawless criminals who use mobile phones with pre-paid SIM cards and fake social media accounts to pursue nefarious activities such as Kidnapping for Ransom and other petty crimes like theft.


Likewise, it promotes accountability in the use of SIM cards and social media accounts.

The following person can claim SSS Death Benefit in the order herein provided.
1. The Spouse of the deceased member
2. The Children of the deceased member
3. The Parents of the deceased member
4. Any person designated in the deceased member's record.

So if the spouse of the deceased member is still alive, the children or the parents of the deceased member can not claim the SSS benefit.

The cash benefit may either be in monthly pension or lump sum paid to the beneficiaries of a deceased member.

Under the SSS Law, The following are the primary beneficiaries
1. Legitimate dependent spouse until the person remarries
2. Member's dependent legitimate, legitimated, or legally adopted, and illegitimate children who are not yet 21 years old.

In the absence of primary beneficiaries, the dependent parents shall be the secondary beneficiaries.

In their absence, any other person designated by the member as a beneficiary in the member's record.

Note:
To be able to claim SSS Death Benefit and to be entitled to the monthly pension, the deceased SSS member must have paid at least 36 monthly contributions before the semester of death.

Failure of the deceased to contribute at least 36 monthly contributions will entitle him/her to a lump sum payment, not the monthly pension.

The SSS reaches out to all Filipinos abroad. For OFW's with existing SSS numbers, there is no need to register again. You may proceed to pay your SSS contribution using your existing SSS number and indicate your existing status as an OFW member.

How To Secure An SSS Number As An OFW?

OFW who has not been issued an SSS number and are applying for membership for the first time should follow this procedure:

1. Obtain from the SSS the OW-1 form or overseas worker record. You may also download the OW-1 from the SSS website.

2. When filling out the OW-1 form, follow the following:

a. When filling out the form, please use a black pen only.

b. Below the field personal data,

1) Write surname first, then your given name, and lastly, your maiden name.
2) Below it, write your complete address.
3) A space is also provided where you can write your address abroad.
4) Don't forget to write the postal code in the space provided
5) Write your date of birth numerically using the month, day, and year format and write beside it your monthly salary in Philippine pesos 6) Under membership applied for, check the box that points to the program you are applying for then check your civil status
7) Write your place of birth and religion
8) Indicate your phone number with its respective area code in the Philippines and abroad.
   
c. Below the field entitled Beneficiaries

1) Write the names of your father and mother and their date of birth. Write deceased if they are no longer living
2) If you are married with children, you are also required to write their names and date of birth
3) Check the column legitimate and/or incapacitated opposite the child's name if applicable
4) In the field other beneficiaries, you need to write the name or names of the person whom you will designate as your beneficiary if you have no spouse, child, or parent. Indicate their date of birth and your relationship with them.
5) Write "not applicable" to the field that does not apply to you.
6) Lastly, Affix your signature at the certified correct portion of your OW-1 form as well as your left and right thumb mark at the opposite side.

3. After accomplishing the OW-1 form, you may now submit it to the SSS office near you in 2 copies together with the original or certified true copy and photo copy of the following supporting documents:

a. Primary documents
      1) Birth certificate
      2) Baptismal certificate
      3) Passport
      4) PRC card
      5) Seaman's book

In the absence of the above primary documents, submit any two of the following documents

b. Secondary Documents
      1) Record of employment
      2) Employer ID
      3) Company ID
      4) Driver's license
      5) Postal ID
      6) NBI clearance
      7) Voter's ID
      8) School ID
      9) Credit card or ATM card with cardholder's name
      10)Bank account passbook
      11)OWWA card
      12)Fisherman's card issued by BFAR
      13)GSIS member's record
      14)Certification from National Archives
      15)Alien Certificate of Registration

4. Married person should also submit a marriage contract when applying for an OFW membership in the SSS

5. If the applicant has children, the original or certified true copy of birth or baptismal certificate of children and/or other pertinent documents should be submitted to the SSS for authentication purposes

6. For OFW's located in a country without an SSS branch, submit your form through the mail, e-mail, or send a fax to the foreign branch expansion and monitoring department, SSS main building, Diliman, Quezon City

You will be given a personal copy of this form wherein your lifetime SSS number is indicated

7. Your coverage will start upon the first payment of your contribution

Social Security System Death Benefit is a cash benefit either in monthly pension or lump sum paid to the beneficiaries of a deceased member.

The primary beneficiaries are
1. The legitimate dependent spouse until the person remarries, and
2. The member's dependent legitimate, legitimated, or legally adopted, and illegitimate children who are not yet 21 years old.

What Happens if there are no primary beneficiary?

In the absence of primary beneficiaries, the dependent parents shall be the secondary beneficiaries. In their absence, any other person designated by the member as beneficiary in the member's record.

There are two types of death benefit paid to beneficiaries of a member:
1. Pension
2. Lump sum Amount

To be entitled to a Pension, the deceased member must have paid at least 36 monthly contributions before the semester of death.

Lump sum Amount is granted to the primary beneficiaries of a deceased member who had paid less than 36 monthly contributions before the semester of death.

In the absence of primary beneficiaries, the secondary beneficiaries are granted the death benefit in lump sum amount. The secondary beneficiary is the dependent parents.

How much will be the monthly pension?

The amount of monthly pension will depend on the following:
1. Members total paid contribution
2. His credited years of service
3. Number of dependent minor children. The number of dependent minor children must not exceed  (4) Minor is a child whose age is below 21 years.

Monthly pension is computed in 3 ways. The highest amount resulting from either one of these three pension formula will be the one used.
1. The sum of P300 plus 20% of the average monthly salary credit plus 2% of the average monthly salary credit for each credited year of service (CYS) in excess of ten years; or
2. 40% of the average monthly salary credit; or
3. P1,000, if the CYS is less than 10, P1,200 if with at least 10 CYS or P2,400, if the CYS is 20 or more.

Are you qualified to received the death benefit? Then it's time to file a claim for SSS death benefit.
 
Go to the nearest SSS office near you and obtain an SSS Death Claim Application form.

Before filling-up the form, please read the instructions at the back.

   Print all data required in the form. The form is divided in 2 part.
   Part 1 is the members information. You must provide the deceased
   SSS member's details. Write down the SS number, the deceased member's
   complete name starting with the surname followed by given name and
   lastly the maiden name

   Next, indicate the member's date of birth and the date and place of
   death.

   Check the specified box if you are claiming under social security
   or employees compensation. Check employees compensation if the
   death is proven to be work connected.

   Indicate the member's civil status is single, married, separated or
   widow or widower.

   The next portion is the deceased member's employment history. Print
   down starting with the most recent. One by one indicate the deceased
   previous employer or the registered business name, the company's
   address and the duration of each employment.

   You can use a separate sheet if necessary. If the space provided is
   not enough.

   The next portion is the dependent children. Under dependent children,
   write down the names of the member's children below 21 years old,
   starting with the youngest down to the oldest. If he has an
   incapacitated child, you may still include him/her even if above
   21 years old. Write down the child's name followed by the date of
   birth, put a check mark if the child is legitimate or illegitimate
   and write down the child's address.

   Next is the claimant's information portion, the portion you as
   a claimant of the death benefit fills up.

   Write down your SS number if any, complete name starting with your
   surname followed by your given name and lastly your middle name.

   Write down your residence or home address by indicating your house
   number, street and subdivision, barangay, town or district and
   your city or province. Don't forget to write down your postal code.
 
   Write down also your date of birth, indicate by checking the box
   whether you are male or female and your relationship to the
   deceased SSS member.

   Write down your TIN or tax identification number, your land line
   telephone number or mobile number with area code and check your
   preferred mode of payment whether cash card,ATM or passbook in
   case you are qualified to receive pension.

   Lastly, at the lowest portion of the death claim form, don't forget
   to fill up your information and the acknowledgment stub.

   Part 11 of the death claim application form located at the back
   verifies if you are already receiving pension from the SSS. Check
   the appropriate box, whether yes or no. If yes, indicate by
   checking the box whether you are receiving your pension via
   disability, retirement or survivor's pension from a deceased
   love one.

   If you are already receiving a survivor's pension, write down
   the SS number and complete name of the deceased member, the name of
   the bank, the bank's address, the savings account number where
   you are already receiving your pension.

   If you are receiving pension under disability or retirement, you
   just need to write down the bank information as stated.

   You have a choice to receive the death pension thru the same bank
   where you are receiving your previous SSS pension or choose to
   open a different savings account. If you prefer to open a different
   savings account, SSS will provide a letter of introduction in order
   to endorse you to your bank of choice. Once a new account is opened,
   you also need to indicate the bank detail on that part of the form.

   Lastly, the member's certification portion of the form. Read the
   certification and waiver thoroughly, after which affix your signature
   over your printed name on the space provided and write down the
   date of signing. Affix your right thumb mark and right index mark
   in the box provided. If you can not sign, let 2 witnesses sign
   over their printed name on the space provided and write down the date.

   Part 111 of the form is the photo and signature card. Write down
   again the SS number and complete name of the deceased member and
   your SS number as claimant if any, and complete name as the claimant.
   Once again sign and affix your thumb mark and index mark in the
   space provided and let 2 witnesses sign over their printed name in
   the space provided. Lastly, Attach your 1X1 photo.

   Depending on your case, additional requirement may be required
   upon interview.

   You may also be required to fill up additional form in support
   of your application for death benefit claim.

Procedure for Employed Member

Part 1
a. Obtain an SSS maternity notification form from the nearest SSS office where you live. This form may be downloaded for free from the SSS website.

   You can download the SSS maternity notification form here.

b. Don't forget to print all the data required in the form such as your name, SSS number, residence, and postal code. You must also print your date of birth, TIN number, landline or mobile number, and email address if you have one. All these fields are found in the upper portion of the MAT-1 form

c. Fill out the required data in the middle portion of the form. The middle portion is the membership certification portion.

Print whether it is your 1st, 2nd, 3rd, or 4th pregnancy. The 5th delivery or miscarriage is no longer entitled to maternity benefits.
 
Indicate the date of your expected delivery. There is also a field wherein you must affix your signature over your printed name. Print the date that you signed.

For those who are unable to sign for any reason, affix your right thumb mark and right index mark in the boxes provided in the form.
Let 2 witnesses sign in the space provided and write down the date.

Part II
a. This is the portion of the SSS maternity notification form to be filled up by the human resources or personnel manager of the company where you work.

b. The fields to be filled up in this portion of the notification form include the employer's SSS number, Employer name or registered business name, Company address, postal code, and company landline phone number or mobile number. This portion also includes the fields for the employer's name and signature or his/her authorized representative and his/her official designation in the company and the date of signing.

c. Check to be sure that your employer signed over his/her printed name or his/her authorized representative the employer certification portion of the SSS maternity notification form which certifies that your employer acknowledged the fact of your pregnancy and the expected date of delivery.

Part III
This is the portion of the SSS maternity notification form, found in the lowest portion of the form and for SSS use only.

Note: You must submit this form as soon as your pregnancy is confirmed or at least 60 days from the date of conception. Don't forget to attach the proof of pregnancy with the notification form.

Your employer will be the one to notify the SSS of your pregnancy. (the fact that you submitted the SSS maternity notification form)

Remember that failure to comply with the rule on notification may result in the denial of the maternity benefit claim.

Since it will be your company representative who will file the maternity notification on your behalf, provide him/her with a xerox copy of your SSS ID. If your SSS ID is not available, you may provide 2 valid IDs duly certified by you and authenticated by an authorized company signatory.

SSS maternity notification may now be submitted online, provided you and your employer are both registered with My.SSS

      Once approved, your SSS maternity benefit will be advanced to
      you by your employer within 30 days from the filing of maternity
      leave application.
   
 
Procedure for voluntary, unemployed or self-employed member

1. Accomplish only part 1 of the SSS maternity notification form. (the upper half portion of the SSS maternity notification form)
2. Proof of Pregnancy (the doctor's certification that you are pregnant and the ultrasound result if you have.
3. Submit the SSS maternity notification form and proof of pregnancy.

Note: In the case of Voluntary, Unemployed, and Self-employed members, the Social Security System will pay the maternity benefit directly to you upon submission and approval of your maternity benefit
reimbursement application.

When To File SSS Maternity Notification?

a. For Employees and Employers:
As soon as a member becomes pregnant, she must immediately notify her employer of such pregnancy and the probable date of her childbirth at least 60 days from the date of conception by completing the SSS Maternity Notification Form and by submitting proof of pregnancy.

The employer must, in turn, notify the SSS through the submission of the maternity notification form and proof of pregnancy immediately after the receipt of the notification from the employee member.

Notification may be made over the counter at an SSS branch, or online through the SSS Website (www.sss.gov.ph), in which the member/employer must be a registered user.

b. For Unemployed, Self-employed and Voluntary Members:
Unemployed, self-employed or voluntary paying members should notify the SSS directly.

Effects of failure or delay in notification 
If the employee fails to notify the employer, or the SSS, in the case of an unemployed, self-employed, or voluntarily paying member, the maternity benefit application may be denied.

Social Security Act of 1997 (RA 8282)

Salient Features of the SSS Law

Employer - Any person, natural or judicial, domestic or foreign who
carries on in the Philippines any trade, business, industry undertaking
or activity of any kind and uses the services of another person who is
under his orders as regards employer. A self-employed person shall be
both employee and employer at the same time.
      Exempt employer: government and any of its political subdivisions,
      branches and instrumentality, including GOCCs (Government Owned
      and Controlled Corporations.

Beneficiaries:
1. Primary Beneficiaries
         a. Dependent Spouse until remarriage
         b. Dependent Legitimate or Legitimated or Legally Adopted and
            Illegitimate Children
2. Secondary Beneficiaries - Dependent Parents
3. Other Beneficiaries - Absent primary and secondary beneficiaries,
   any other person designated by member as secondary beneficiary.

   As to DEATH BENEFITS, If no beneficiary qualifies under the Act,
   benefits shall be paid to Legal Heirs in accordance with Law
   of Succession.

SSS (Social Security System) Benefits
1. Monthly Pension - minimum pension is 1,200 for members with at
   least ten (10) credited years of service and 2,400 for those with
   twenty (20) credited years of service.
2. Dependents Pension - 10% of the monthly pension or 250 whichever
   is higher. Limit - 4 children
3. Retirement
4. Death
5. Permanent Disability
6. Funeral
7. Sickness
8. Maternity (ONLY 1ST FOUR (4) DELIVERIES OR MISCARRIAGES)

Coverage
1. Compulsory - 1. All employees not over sixty (60) years of age and
                   their employers compulsory coverage of the employer
                   shall take effect on the first day of his operation
                   and that of the employee on the day of his employment
                2. Self-employed employees as may be determined by the
                   Commission under such rules and regulations as it
                   may prescribe, including, but limited to: all
                      a. Self-employed professionals;
                      b. partners and single-proprietors of business;
                      c. actors and actresses, directors,scriptwriters
                         and news correspondents not employees;
                      d. professional athletes, coaches, trainers and
                         jockeys, and
                      e. individual farmers and fishermen; upon their
                          registration with the SSS.
                3. Domestic helpers who are sixty years of age and below
                   with a monthloy income of not less than P1,000 on the
                   date of their employment
                4. individual farmers and fishermen under SS (Social
                   Security) rules and regulations
2. Voluntary -  1. Filipinos recruited by foreign-based employers for
                   employment abroad
                2. Employee separated from employment
                3. Self-employed – realizes no income
                4. Spouse who devotes full time managing household and
                   family affairs unless specifically mandatorily covered
3. By Arrangement - any foreign government, international organization
   or wholly owned instrumentality employing workers in the Philippines
   or employing Filipinos outside the Philippines may enter agreement
   with Philippines for inclusion of such employees in SSS EXCEPT those
   already covered by their respective civil service retirement system.

Exceptions From Coverage
1. Employment purely casual and not for purpose occupation, or business
   employer
2. Service performed on or in connection with alien vessel, if
   employed when such vessel is outside of Philippines
3. Employees of Philippine government or instrumentality or agency
   thereof
4. Service performed in the employee of a foreign government, or
   international organizations, of wholly owned instrumentality employing
   workers in the Philippines or employing Filipinos outside of
   the Philippines
5. Services performed by temporary and other employees excluded by SSS
   regulation; employees of bonafide independent contractors shall not
   be deemed employees of the employer engaging the services of an
   independent contractor

Effective Date of Coverage - Compulsory coverage of the employer shall
take effect on the first day of his operation and that of the employee
on the first day of his employment Provided, That the compulsory
coverage of! the self-employed person shall take effect upon his
registration with the SSS.

Maternity leave is the period of absence from work granted to a mother before and after the birth of her child.

SSS Maternity Leave Benefits
1. Daily cash allowance
2. Leave from work

Who is entitled to maternity leave?
1. Female employee
2. Voluntary member - (separated from work)
3. Self-employed member

How long will the daily cash allowance be paid?
1. 60 days for normal delivery
2. 78 days for cesarean section delivery

Limitations in the Grant of maternity benefits
1. 5th deliveries or miscarriages are no longer paid. Only the first 4 deliveries or miscarriages are paid.
2. A female member cannot claim for sickness benefit when she has been paid the maternity benefit.

Requirements before the grant of maternity leave benefit
1. Must have paid at least 3 monthly contributions within the 12-month period immediately preceding the semester of her childbirth or miscarriage.
2. Must have given notification to:
a. Employer - if employed
b. SSS - if separated from work
c. SSS - if self-employed
3. Notification must be given of the fact of pregnancy and the probable date of her childbirth at least 60 days from the date of conception.
4. Submit proof of pregnancy

Note: Failure to observe the rule on notification may result in the denial of the maternity claim.

How will the claimant female employee be paid?
1. She is paid directly by the SSS
2. She is paid by the employer in advance if employed, within 30 days from the date of filing of the maternity leave application. The SSS will then reimburse the employer upon receipt of proof of payment.

SSS Paternity Leave Benefits


The working father or husband may not be aware that  there is a law called the Paternity Leave Act of
1996, otherwise known as RA. 8187.

This law provides that a married male employee or worker is entitled to 7 days leave with pay when his wife gives birth or when his wife suffers a miscarriage.

The Purpose of this Paternity Leave law is to give an opportunity to the working male employee to give support to his wife and help in caring for the newly born child.

To be entitled to this 7 day leave with pay, the male employee must inform his employer of the fact that his wife is pregnant and tell his employer of the expected date of delivery.

This privilege is good only up to the first 4 delivery. The wife's 5th delivery will no longer entitle the male employee of Paternity leave.

The employer has no right to deny the male employee of his right to paternity leave because doing so will make the employer liable for fine or imprisonment.

So it is good news for us Male employees that when our wife delivers a baby or suffers a miscarriage, we can leave our work to take care of our wife and baby for a period of 7 days with pay.

This Paternity leave privilege granted by law can be availed of by employees in the private sector as well as employees in the public sector.

Please remember that your wife must be legitimate. Meaning, you are legally married. Your kabit or
mistress delivery or miscarriage will not entitle you to the benefit of the Paternity leave law.

Note: File the Paternity Leave with the Employer and not
with the SSS.

1. The Social Security System Pays only up to the first four deliveries. The Fifth child or delivery will no longer be paid by the SSS.

2. You can not claim SSS maternity benefit and SSS sickness benefit at the same time.

3. For those who are employed, it is the employer and not the SSS who will pay the SSS maternity benefits. The Employer in turn will reimburse from the SSS what it paid the employee.

4. The woman employee must notify her employer of the fact of her pregnancy. Those who no longer work or who are self-employed must notify the SSS directly.

5. Not only those who work are entitled to maternity benefit but also those who no longer work provided she paid 3months of contribution within the twelve-month period immediately preceding the semester of her childbirth.

6. The Employer will be liable to pay SSS the benefits due to the employee plus damages in case he fails to pay the contribution or fail to notify the SSS.

7. The pregnant employee is entitled to a maternity leave of 60 days. This 60 days period may be extended at the request of the women employee. But the woman employee can not just request for an extension for the sake of just extending. The reason for a request to extend must be due to illness medically certified to arise out of her pregnancy or delivery.

Illustrative Case - Paternity Leave

Jimmy Garcia had been an employee of Makshaft Services Limited for the last ten
(10) years. His wife of six (6) years died last year. They had four (4) children.
He then fell in love with Ritchie, his co- employee, and they got married.

In October this year, Jimmy's new wife is expected to give birth to her first child.
He has accordingly filed his application for paternity leave, conformably with
the provisions of the Paternity Leave Law which took effect in 1996. The HRD
manager of the  firm denied his application, on the ground that Jimmy had already
used up his entitlement under the law. Jimmy argued that he has a new wife who
will be giving birth for the first time, therefore, his entitlement to paternity leave
benefits would begin to run anew.

(a) Whose contention is correct, Jimmy or the HRD manager?

ALTERNATIVE ANSWER:
The contention of Jimmy is correct. The law provides that every married male is
entitled to a paternity leave of seven (7) days for the first four (4) deliveries
of the legitimate spouse with whom he is cohabiting. Ritchie is Jimmy's legitimate
spouse with whom he is cohabiting. The fact that Ritchie is his second wife and that
Jimmy had 4 children with his first wife is beside the point. The important fact is
that this is the first child of Ritchie with Jimmy. The law did not distinguish
and we should therefore not distinguish.

The paternity leave was intended to enable the husband to effectively lend support
to his wife in her period of recovery and/or in the nursing of the newly born child.
(Sec. 3, RA. No. 8187) To deny Jimmy this benefit would be to defeat the rationale
for the law. Moreover, the case of Jimmy is a gray area and the doubt should be
resolved in his favor.

ALTERNATIVE ANSWER:
Jimmy's contention is correct. R.A. No. 8187 provides that paternity leave of (7)
days with full pay shall be granted to all married employees in the private and
public sectors for the first four (4) deliveries of the legitimate spouse with whom
he is cohabiting. With the death of Jimmy's first wife, the first (4) deliveries
provided by law, shall apply to the new legitimate spouse of Jimmy with whom he is
cohabiting.

ALTERNATIVE ANSWER:
Since R.A. No. 8282 is silent on the matter, the doubt should be resolved in favor
of the second wife.


b) Is Ritchie entitled to maternity leave benefits?
      Yes, Ritchie's maternity benefit is personal to her and she is entitled under
      the law to avail herself of the same for the first four times of her deliver.

How to Apply or How to File Paternity leave in SSS?
This is one of the questions I usually read from the Internet, Remember
that Paternity Leave Law is a law different from the SSS law. Paternity leave
is a privilege given to a husband to absent himself from work for
a period of 7 days with pay. The leave is filed with the company where
the employed husband is working and not with the SSS.
