Article 243. Orders or requests by executive officers to any judicial authority. - Any executive officer who shall address any order or suggestion to any judicial authority with respect to any case or business coming within the exclusive jurisdiction of the courts of justice shall suffer the penalty of arresto mayor and a fine not exceeding one hundred thousand pesos (P100,000).

ELEMENTS:
1. That the offender is an executive officer;
2. That he addresses any order or suggestion to any judicial authority; and
3. That the order or suggestion relates to any case or business coming within the exclusive jurisdiction of the courts of justice.


Legislative or judicial officers are not liable under this article.

The purpose is to maintain the independence of the judiciary from executive dictations.
