Article 237. Prolonging performance of duties and powers. - Any public officer who shall continue to exercise the duties and powers of his office, employment, or commission beyond the period provided by law. regulation or special provisions applicable to the case, shall suffer the penalties of prision correccional in its minimum period, special temporary disqualification in its minimum period, and a fine not exceeding one hundred thousand pesos (P100,000).
ELEMENTS:
1. That the offender is holding a public office;
2. That the period provided by law, regulations, or special provisions for holding such office has already expired; and
3. That he continues to exercise the duties and powers of such office.
The article contemplates officers who have been suspended, separated, declared over-aged or dismissed.
