1997 Bar Exam Question

A had a grudge against F. Deciding to kill F, A and his friends, B, C, and D, armed  themselves with knives and proceeded to the house of F, taking a taxicab for the purpose.

About 20 meters from their destination, the group alighted and after instructing E, the driver, to wait, traveled on foot to the house of F.

B, positioned himself at a distance as the group's lookout. C and D stood guard outside the house. Before A could enter the house, D left the scene without the knowledge of the others.

A stealthily entered the house and stabbed F. F ran to the street but was blocked by C, forcing him to flee towards another direction. Immediately after, A had stabbed F, A also stabbed G who was visiting F.

Thereafter, A exited from the house and together with B and C, returned to the waiting taxicab and motored away.

G died. F survived.

Who are liable for the death of G and physical injuries of F?

A alone is liable for the death of G. The object of the conspiracy of A, B, C, and D was to kill F only. Since B, C, and D did not know of the stabbing of G by A, they can not be criminally held liable therefor.

E, the driver cannot be also held liable for the death of G since the former was completely unaware of the said killing.

For the physical injuries of F, A, B, and C should be held liable therefor. Even if it was only A who actually stabbed and caused physical injuries to G, B and C are nonetheless liable for conspiring with A and for contributing positive acts which led to the  realization of a common criminal intent.

B positioned himself as a lookout, while C blocked F's escape. D, however, although part of the conspiracy, cannot be held liable because he left the scene before A could enter the house where the stabbing occurred. Although he was earlier part of the conspiracy, he did not personally participate in the execution of the crime by acts which directly  tended towards the same end. (People vs. Tomoro, et al 44 Phil. 38)

In the same breath, E, the driver, cannot be also held liable for the infliction of physical injuries upon F because there is no showing that he had knowledge of the plan to kill F.

5. When he has been baptized or customarily known by such alias
6. When authorized by a competent court (CA. No.142, as amended by RA. 6985).
7. When properly indicated in a certificate of candidacy (Omnibus Election Code)

The Professional Regulation Commission (PRC) announces that 890 out of 1,591 passed the November 2018 Dentist Licensure Examination (Written Phase) and 786 out of 905 passed the Dentist Licensure Examination (Practical Phase) given by the Board of Dentistry in Manila this December 2018.

After drinking one (1) case of San Miguel beer and taking two plates of "pulutan", Binoy, a Filipino seaman, stabbed to death Sio My, a Singaporean seaman, aboard M/V "Princess of the Pacific", an oversees vessel which was sailing in the South China Sea.

The vessel, although Panamanian registered, is owned by Lucio Sy, a rich Filipino businessman. When M/V "Princess of the Pacific" reached a Philippine port at Cebu City, the Captain of the vessel turned over the assailant Binoy to the Philippine authorities.

An information for homicide was field against Binoy in the Regional Trial Court of Cebu City. He moved to quash the information for lack of jurisdiction.

Yes, the Motion to Quash the information should be granted. The Philippine court has no jurisdiction over the crime committed since it was committed on the high seas or outside of Philippine territory and on board a vessel not registered or licensed in the Philippines.(US vs. Fowler, 1 Phil 614)

It is the registration of the vessel in accordance with the laws of the Philippines, not the citizenship of her owner, which makes it a Philippine ship. The vessel being registered in Panama, the laws of Panama govern while it is on the high seas.

1. There are two schools of thought in Criminal Law, and these are

a. the Classical Theory, which simply means that the basis of criminal liabilities is human free will, and the purpose of the penalty is retribution which must be proportional to the gravity of the offense; and

b. the Positivist Theory, which considers man as a social being and his acts are attributable not just to his will but to other forces of society. As such, punishment is not the solution, as he is not entirely to be blamed; law and jurisprudence should not be the yardstick in the imposition of sanction, instead the underlying reasons would be inquired into.

2. We follow the classical school of thought although some provisions of eminently  positivist in tendencies, like punishment of impossible crime, Juvenile circumstances, are incorporated in our code.

The Professional Regulation Commission (PRC) and the Board for Professional Teachers (BPT) announces that 19,659 elementary teachers out of 72,054 examinees (27.28%) and 22,271 secondary teachers out of 85,823 examinees (25.95%) successfully passed the Licensure Examination for Teachers (L.E.T.) given last March 24, 2019, in 20 testing centers all over the Philippines. It is further announced that of the 19,659 elementary teacher passers, 5,078 are first timers and 14,581 are repeaters. For the secondary teachers, 15,621 passers are first timers and 6,650 are repeaters.

The Board for Professional Teachers is composed of Dr. Rosita L. Navarro, Chairman; Dr. Paz I. Lucido, Vice Chairman; Dr. Paraluman R. Giron and Dr. Nora M. Uy (on leave), Members.

The results of examination with respect to ten (10) examinees were withheld pending final determination of their liabilities under the rules and regulations governing licensure examinations.

June 2019 Nurse Licensure Examination Results 

The Professional Regulation Commission (PRC) announces that 5,059 out of 9,691 passed the Nurse Licensure Examination given by the Board of Nursing in the cities of Manila, Baguio, Cagayan de Oro, Cebu, Davao, Iloilo, Legazpi, Lucena, Pagadian, Tacloban, Tuguegarao, and Zamboanga this June 2019.

The top 3 performing schools in this examination are

            The members of the Board of Nursing who gave the licensure examination are

Pursuant to Section 16, of Republic Act No. 9173, “all successful candidates in the examination shall be required to take an oath of professional before the Board or any government official authorized to administer oaths prior to entering upon the nursing practice”.
From July 3 to July 12, 2019, registration for the issuance of Professional Identification Card (ID) and Certificate of Registration will be done online.  

Please go to www.prc.gov.ph and follow instructions for initial registration.  

Those who will register are required to bring the following: 
  • downloaded duly accomplished Oath Form or Panunumpa ng Propesyonal, 
  • notice of admission (for identification only),
  • 2 pieces passport sized pictures (colored with white background and complete name tag),
  • 2 sets of documentary stamps and 1 piece short brown envelope. 

  Successful examinees should personally register and sign in the Roster of Registered Professionals.

Lt.Gen. Benjamin Madrigal | The next AFP chief of staff

Lt. Gen. Benjamin Madrigal will be the next AFP Chief of Staff to succeed Gen. Carlito
Galvez, who will retire on Dec 12, 2018.

Madrigal will replace Gen. Carlito Galvez Jr., who will reach the mandatory retirement
age of 56 on December 12.

Madrigal’s closest contender was Army chief Lt. Gen. Macairog Alberto. Both had been 
assigned in Davao, the President’s home region.

Madrigal took the helm of the Davao-based Eastmincom on November 2017, after Gen. Rey
Leonardo Guerrero was appointed chief of staff.

He also previously served as commander of Southern Luzon Command, assistant chief of
10th Infantry Division and commander of 4th Infantry division.


Things You Need To Know About Lt. Gen. Benjamin Madrigal


He is a member of the Philippine Military Academy “Sandiwa” Class of 1985.

He obtained a Master In Public Administration degree at the Philippine Christian
University in 2006.

He has a Master of Management Studies at the University of New South Wales, Canberra in
1999.

He is the head of the Eastern Mindanao Command before his appointment to succeed Gen.
Carlito Galvez.

He was the commander of the 701st Infantry Brigade in Mati, Davao Oriental before
becoming the head of the Eastern Mindanao Command.

Other positions previously held by lieutenant General Benjamin Madrigal are the following:
1.Served as assistant division commander of the 10th Infantry Division in Mawab, Compostela
Valley;
2.Commander of the 4th Infantry Division in Camp Evangelista, Cagayan de Oro City; and 3.Commander of Southern Luzon Command in Camp General Nakar, Lucena City.

Madrigal is set to retire on Sept. 28, 2019.

He will be the 50th AFP Chief of Staff.


COMELEC Gun Ban 2019

Application for Gun Ban exemption is happening at the CBFSP Office at the COMELEC Main
Office in Intramuros. It is open from 8 am to 5 pm to accept applications.

Election gun ban runs from January 13 until June 12, 2019 for the upcoming National and
Local Elections on 2019.

Application for exemption from the gun ban and other prohibited acts runs from
December 1, 2018 until may 29, 2019.

Qualified persons may apply for a certificate of authority at the COMELEC through the
Committee on the Ban on Firearms and Security Personnel (CBFSP).

Forms and requirements must be submitted to the CBFSP office, COMELEC Main Office in
Intramuros, Manila.
